The word “outbuilding” covers very different proposals, from a tool shed to a garden office, garage, gym or annex. The planning route depends on the building, the property, previous permissions and what will happen inside it, so a small footprint does not justify a generic answer.

Choose between permitted development, a certificate and permission

England's householder outbuilding right is subject to limits, conditions and exclusions. It is not a universal exemption: it does not apply in the same way to flats, maisonettes or every dwelling created by a change of use, and rights can be restricted by a condition or Article 4 direction. A building used as a separate dwelling or for a non-incidental business use also needs a different assessment.

If the proposal appears permitted development, a proposed lawful development certificate can provide formal evidence of lawfulness. If a limit is exceeded or the right is unavailable, use the authority's planning application route. Listed building consent, building regulations and restrictive covenants are separate matters.

Map the whole property and the exact footprint

The location-plan red line will commonly follow the residential planning unit rather than hugging the new structure. A detailed existing-and-proposed site plan should make the calculations and spatial relationships testable.

  • House, existing extensions and all relevant existing outbuildings
  • Proposed footprint with length and width
  • Shortest distances to the house and site boundaries
  • Areas of garden, hardstanding, access and parking affected
  • Trees, hedges, retaining walls and level changes where relevant
  • North, identified scale, scale bar, sheet size and revision

Use design drawings to prove height, form and use

Mapping cannot establish whether the building meets a height rule or is capable of the stated use. Provide dimensioned floor plans, every elevation and a roof plan or section where needed. Show eaves and overall height from the relevant ground level, roof form, openings, materials and internal layout.

State the proposed use precisely. Labels such as “garden room” do not resolve whether it will remain incidental to the house, become self-contained accommodation or support a material business use.

Check for reports and site constraints

The local validation list may trigger a heritage statement, tree or arboricultural information, ecology evidence, drainage detail, contamination information or a noise assessment. Trees, ponds, old roofs and demolition can make ecology relevant even to a modest structure.

Householder applications are exempt from England's statutory biodiversity gain condition. A non-householder scheme, such as a separate dwelling or some commercial proposals, requires its own current BNG assessment and may instead rely on another exemption.

Apply the rules for the correct UK nation

The detailed permitted-development limits cited by England's technical guidance do not apply unchanged in Wales, Scotland or Northern Ireland. Use the national rules and the receiving planning authority's current validation list; protected areas, listed-building status and earlier conditions can affect the answer in every nation.
